Tanrının Kozmik Hükümranlığını Siyasal Bir Dile İndirgemek: Radikal Yaklaşım İçinde Egemenlik Nasıl Yanlış Yorumlanıyor?

Abstract
Egemenlik kavramı üzerindeki özel yaklaşım radikal İslam anlayışının temel ayırt edici özelliklerinden birisidir. Aşkın varlığa ait olan kozmik ve ontolojik hükmetme potansiyel ve gücünün, özü itbariyle beşeri bir etkinlik sahası olan siyasal pratğe indirgenmesi, bu konudaki karmaşanın temeli olarak görülebilir. Oysa egemenlik, bir kamu hukuku terimi olarak, evrensel hukuki değerlerin kaynağıyla ilgili bir kavram değil, bir devlet unsuru olması yöneyle pozitf hukuk kurallarını vücuda getren en yüksek emretme kudret; devletn ihtyaçlarını karşılayan kuralların ve kurumların kaynağı konumundaki üst iradedir. İlahi iradeyi temsil eden değerler ise her dönemde ve her toplumda geçerli evrensel ilkeleri ifade etmektedir. Dünyevî egemenliğin ilahi ahkâma izafe edilmesi, evrensel ve mutlak olanı, beşeri algıyı yansıtan pozitf hukuk düzeyine indirgemek ve sınırlamak olur. Dolayısıyla hukuki değerlerin (evrensel hukuk ve adalet prensipleri) kaynağı ile pozitf hukuk kurallarını meydana getren beşeri iradenin bir ve aynı sayılması doğru değildir. Bu yaklaşımdan hareketle, makale, dini egemenlik anlayışının ne anlama geldiğini, egemenliğin nasıl yanlış yorumlandığını ve muhtemel çözüm önerilerini ele almaktadır.

Abstract
This artcle deals with the perspectve of radical Islamists on sovereignty, how they misinterpret sovereignty and it includes some possible alternatves in solving this queston. The main aim of the artcle is to demonstrate how the radicals misunderstand Allah’s sovereignty and put forward some suggestons to shed light on the issue. We can say that the main reason of tensions between religion and state is conflictng aspiratons and the competton between these two organizatons. This conflict and competton arise from the wish of these two organizatons to take over power and to design social and state life according to their epistemological priorites and ultmate goals. As in all major religious traditons, in the case of Islam, we see that there has also been a tensional relatonship between religion and state or religious and secular law. This tension roots from the meanings that are atributed to the understanding of Allah’s sovereignty. Allah’s dominaton and sovereignty over everything on the Earth in a cosmic and ontological sense is also perceived as absolute politcal sovereignty over peoples. From the perspectve of politcal philosophy, this kind of thinking can express itself as an excluding and killing strategy according to their percepton of what the source of sovereignty is, and how this sovereignty functons.
