This study deals with the relatonship of religion and state ın Germany in its historical process and asserts the rights and freedoms of Muslims living in Germnay. Despite the governmental and spacial afnity of European states, the implementaton of the rerelatonship between religion and state is differental, Comparing Germany with other European countries, we will ascertain Germany’s principle of afrmatve acton towards religious groups The Weimar treaty Germany concluded with muslim groups granted them educatonal, fnancial, legal and religious rights. All rights and freedoms granted with the treaty are not acknowledged to Muslims though. In 2012 another version of the Weimar treaty was signed between muslim groups and the state in Hamburg. But as a mater of fact only a small part of all the rights that has been granted to religous groups, like Catholıc, Protestant and Jewısh, were granted to Muslims The study aims to scope on the content of the mentoned treates and the granted rights to muslim groups. The study indicates that the present and future treates signed with muslim groups need to cast a net wide and with regard to the rights and freedoms granted to Muslims the aim must be to set up an appriopriate legal frameworkas with e.g. halal butchering, lifing the prohibiton against the head-scarf in public ofce and the material and moral support of muslim places of worship.
